The contract between the Seller and the Buyer is considered concluded when the order is confirmed by the Seller. Confirmation can be done by email / sms, when the buyer is notified that the order placed by him on the website has the status “Order Confirmed”, without the need for a confirmation of receipt from the Buyer, or by phone, at the Buyer’s request, Once the contract is concluded, i.e. the confirmation of the placed order, the buyer has the obligation to pay the counter value of the products plus any transport costs involved, which have been brought to his attention previously, in the steps of placing the order online. 4. Product warranty:
All products sold by SC KA PROMOTION LINE S.R.L benefit from warranty conditions in accordance with the legislation in force, namely Law 449/2003.
The offered guarantee does not affect the rights of consumers provided by Law no. 449/2003 and OG no. 21/1992.
Warranty conditions and rules:
1. Determination of deficiencies
Remedy of detected deficiencies, replacement of products for which their repair is not possible, respectively restitution of the value of purchased products in the situation where repair or replacement measures are not possible (in the mentioned order) is carried out by the selling company.
1. The guarantee loses its validity in case of:
– use/use/incorrect/defective/non-compliant use/use/maintenance instructions delivered with the product;
– abusive; abusive use and changing the destination of the product are considered

a. When requesting the granting of the guarantee, the product must be presented together with all its accessories and, as far as possible, in the original packaging.

5. Conditions for returning products
Our wish is that the products we offer you are in full agreement with your needs. Otherwise, according to Ordinance no. 34/2014 regarding the legal regime of distance contracts, the products can be returned within 14 calendar days of receiving the parcel: “Unless the professional has offered to recover the products himself, the consumer returns the products or hands them to the professional or an authorized person of the professional to receive the products, without undue delay and within no more than 14 days from the date on which he notified the professional of his decision to withdraw from the contract in accordance with article 11. The term is respected if the products are sent back by the consumer before after the expiration of the 14-day period”. Unilateral termination of the contract within 14 days applies only to natural persons, legal persons not having this possibility.

In the situation mentioned above, our customers can return the product within the time limit provided above bought, without showing any signs of damage or wear. If the product has signs of use and wear, according to Ordinance 34/2014 “The consumer is only responsible for the decrease in the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and functioning of the products”, according to art 14 (3) of GEO 34/2014.
SC KA PROMOTION LINE S.R.L. undertakes to return to the customer the sums collected for the returned products, within 14 calendar days from the receipt of the product based on a notification sent by email to the address mentioned above, completed by the customer. In the written notification, all the data and the owner’s bank account, the order number, the return pick-up address are filled in. The shipping costs, in the case of the return, will be borne by the consumer according to Ordinance 34/2014: “The consumer bears only the direct costs related to the return of the products”. The amount returned to the customer includes all the money received by the seller from the customer for the respective product, including the initial shipping costs, if applicable. All returned products for which the full amount is returned must be in perfect condition, without visible traces of use and all auxiliary materials inside the packaging (chargers, instructions for use, gift products if applicable, etc.)

6. Terms and conditions for returning products:
According to Ordinance no. 34/2014, regarding the legal regime of distance contracts, the products are returned within 14 calendar days, from the receipt of the package, without citing a reason. In the situation mentioned above, customers can return, within the term provided above, the products purchased as follows:

For reasons of hygiene, panties, underwear or sets containing panties or intimate items are NOT ACCEPTED FOR RETURN.
For orders that contain products sent incorrectly by SC KA PROMOTION LINE S.R.L., the costs of returning and reshipping the products will be fully borne by SC KA PROMOTION LINE S.R.L. The products will be returned to the seller by courier, without refund, after a telephone or email notification from the seller, using the contact details on the website, and the seller will use the same method of reshipping the product. The buyer must ensure proper packaging of the returned product, in order not to suffer damage during transport.
The consumer has the right to cancel the order within 24 hours. However, if the package has already been shipped, you will be charged the handling, packaging and shipping costs (round trip + return) as well as the commissions related to the transaction in question and the refund will not be made until the package arrives back to us. Please keep in mind that we try to ship orders on the same day (or a maximum of 24 working hours), so to avoid the imputation of expenses and delayed refunds, inform us about the cancellation of the order on the same day you placed it. The refund period is a maximum of 30 days from the receipt of the return.
For products that arrive damaged at the customer, he has the obligation to notify the seller in writing of this within 24 hours of receiving the package, to the email address shop@4desire.ro, presenting photo / video evidence of the product in question: pictures of the product, packaging and any other information it may consider relevant in this regard. Notifications regarding damage to the product received after the 24-hour period will not be taken into account. SC KA PROMOTION LINE S.R.L pays special attention to the packaging of the products, but unfortunately we cannot control how the parcels are transported through the courier companies, so please check the conformity of the products after you have received your order, or before the representative of the courier company, if you opted for opening the package upon delivery.
According to the new Law 249/2015, Art. 16, point 8, “it is prohibited to condition, in any form, the legal rights of consumers regarding the purchased product by keeping the packaging.” According to the provision of GEO 34/2014 “the end user is only responsible for the decrease in the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and functioning of the products. The decrease in the value of the products must not be discouraging for the end user in exercising the right of withdrawal.” As a result, if the consumer returns the product in a condition that diminishes its value, the merchant is allowed to deduct part of the amount returned to the customer.
SC KA PROMOTION LINE S.R.L undertakes to return to the customer the sums collected for the returned products, within 14 calendar days from the receipt of the returned product, based on the return form or the notification sent by email, completed by the customer. 1.1 Customers who do not honor their obligation to pick up parcels
For a customer who places an order and does not pick it up from the courier company, it is necessary to pay in advance for the next placed order + pay the round trip fees caused by the initial sending of the unpicked order. The repetition of this incident will lead to the obligation to pay in advance for all orders placed to SC KA PROMOTION LINE S.R.L, or the blocking of the respective customer and cancellation from the system without prior notification of the order requests that he places.
2. Fraud
